USA Work Visa (H-1B)
Overview
The H-1B visa is a non-immigrant visa that allows U.S. employers to hire foreign workers in specialty occupations, as well as fashion models and Department of Defense project workers (under certain conditions).
Validity & Duration
Initial stay: 3 years
Maximum stay: 6 years (extensions possible beyond 6 years if green card process is underway)
Annual Cap:
65,000 visas (regular cap)
20,000 additional visas for U.S. master’s degree or higher holders
Who Can Apply?
Foreign workers with a job offer in a specialty occupation
Must hold at least a Bachelor’s degree or equivalent in the related field
A U.S. employer must sponsor the applicant (file a petition with USCIS)
Eligibility Requirements
Valid H-1B petition (Form I-129 approved by USCIS)
Employer–employee relationship (regular salary, legitimate employment)
Clean immigration status (no overstays/violations)
The role must qualify as a specialty occupation
Applicant must possess the required degree or equivalent
Required Documents
Valid Passport (6 months beyond intended stay)
I-797 Approval Notice (from USCIS)
Form DS-160 confirmation page
Visa fee payment receipt
Copy of Form I-129 (H-1B petition)
Employment verification letter (position, salary, job details)
Key Points
Sponsorship by employer is mandatory
If employment ends, the visa holder must:
Leave the U.S., OR
Find a new H-1B sponsoring employer, OR
File for a change of status
A 60-day grace period is provided after job termination
