LMIA for Work Permit

Labour Market Impact Assessment is a document issued by the ESDC (Employment Social Development Canada) assessing the impact of hiring a foreign worker. To hire a foreign national, the Employment and Social Development of Canada (ESDC) issues a document for the employer to hire a foreign national. This approval will be sanctioned by LMIA only when that position cannot be filled in by Canadian citizens or permanent residents of Canada.

To obtain this LMIA, the Canadian employer must demonstrate that they could not fill in the job vacancy, so they wish to recruit a foreign national. They should post in the media about the job vacancy for 90 days. If still the position is not filled by a Canadian citizen or permanent resident, then the employer can recruit a foreign national. They can recruit foreign nationals only with this LMIA approval.

There are two types of LMIA:

  • Positive LMIA
  • Negative LMIA

Positive LMIA- If no Canadian citizen or permanent resident fill in the job position. Then the Canadian employer can hire a foreign national; it gets approval to hire, then it is positive LMIA.

Negative LMIA- If a Canadian employer wishes to fill in a job position with a foreign national; yet, if he is allowed only to hire a Canadian citizen or permanent resident, then; it is negative LMIA.

Permit Credentials-

  • An individual must have any of qualification 10, 12, Diploma, Graduate, Masters, PHD etc.
  • The Age restricted under this category is vary from country to country (Commonly-60)
  • One should have experience in same field applied for is of minimum 1+ Years.
  • This Category Doesn’t Required any kind of Language or professional exam

Work Experience- At least 12-months of continuous, full-time, skilled work experience completed within the previous 10 years (or an equal amount in part-time experience).

Skilled work experience refers to experience classified under NOC Skill Level 0, A, or B.

Language Proficiency- Reach a minimum of Canadian Language Benchmark (CLB) level on an approved English or French language test.

Education- A minimum of a Canadian high school diploma or the equivalent in foreign education as per their ECA bodies.

To work in any country, you need to acquire a work permit from your employer. A Work permit also shows that you are willing to return to your country if your work permit expires and don’t have an extension for the work permit. Obtaining a work permit requires you to provide documents regarding health, examinations and your qualifications as well as record of any criminal activity. Work permit also provides assurance that your employer is not included in any illegal or fraudulent acts and has a legal and stable company or business.

Accountability

The government processing fees must be remitted when submitting an application for permanent residence under the Federal Skilled Worker program. These fees are separate from a candidate’s settlement funds, which must be demonstrated as part of the Federal Skilled Worker eligibility requirements.

The processing fees to apply under the Federal Skilled Worker program are as follows:

A dependent child under the age of 22 who is not a spouse or common-law/conjugal partner, or a dependent over the age of 22 who is unable to support themselves financially due to a physical or mental condition Add $225 each per dependent

A job offer is not required for the Federal Skilled Worker program. In fact, a large majority of candidates invited under the Express Entry system do not have a formal Canadian job offer. That said, having a valid job offer may increase a Federal Skilled Worker’s CRS score by 50-200 points. To qualify for these points, the job offer will likely require a Labour Market Impact Assessment (LMIA).
